Data protection of Card Transactions and Card Data

GDPR- Information about the General Data Protection Directive

Dear Client,

From 25 May 2018 new EU data protection rules will come into force. Cooperation between you and Borgun or B-Payment is affected by two aspects of privacy:

1. Protection of Card Transactions and Card Data

Data used in transactions with bankcards, whether on POS terminals or on-line, are protected in accordance with international Payment Card Industry security regulations and are therefore not accessible to unauthorized persons. Service providers who are involved in transaction processing will only have access to the data that is essential to process the payment transaction, such as: card number, card expiration date, CVC code, Personal Identification Number, data and identifier of the merchant initiating the transaction, transaction date and time.

These data sent through a strictly protected channel to Borgun, and payments through the POS terminal are also anonymized as an additional security guarantee. These data are processed by payment service providers only for the purposes of the payment transaction. Data may only be used for limited purposes outlined in the general terms and conditions of the merchant agreement.

Transaction data can only be provided to third parties, such as authorities, based on regulatory requirements.

In the case of payment by bank card, the cardholder may claim a refund so-called chargeback, which requires the handling your customers’ personal data. Therefore, we recommend that as part of your data-management rule, as a legitimate interest, data on cardholder chargeback should be allowed to hand over to the card acquirer, their representative, or to the Card Associations.

2. Personal Data Required to identify Customer

As a cross-border payment service provider, Borgun is obliged to identify the beneficial owner of the contractual company and the persons acting on behalf of the company in accordance with EU provisions and local laws. This obligation of Borgun is fulfilled with B-Payment's contribution under strictly regulated contractual terms.

Borgun handles identification data necessary to comply with the regulations that require the identification of the beneficial owner. The legal basis for data handling here is compliance with legal requirements. The data thus recorded may only be disclosed to a third party, such as the authorities, by regulatory requirements. Information on data management is provided when requesting and recording the data.
